1. Introduction
Acceptance
Your purchase, use, redemption, or attempted redemption of a gift card constitutes your acceptance to be bound by these Gift Card Terms and Conditions.

If you have any questions, problems or would like more information about your Gift Card, you may get in touch with us via the following methods:
"Access Code" means the 4-digit access code printed on the back of the Digital Gift Card.
"Gift Card" means the MyHouse Digital Gift Card purchased online or physical Gift Card purchased Instore or Online
"MyHouse" or “we” or “us” or “our” means Global Retail Brands Australia Pty Ltd ACN 006 348 205 of Po Box 7224, Melbourne 3004.
“Website” means www.myhouse.com.au
“Residual Value" means, at any time, the unspent or unused portion of the initial value loaded onto your Gift Card.
"Reward Points" means value points added to your MyHouse VIP membership account for each purchase of goods or services in-store or online at the rates published from time to time on the MyHouse Website.
"You" or "your" means the person who has and/or uses the Gift Card for the purposes of these Gift Card Terms and Conditions, or who authorises another person to have or use the Gift Card on their behalf.
3. Gift Card Redemption
Once loaded with value, you can redeem your Gift Card for purchases of Products in-store and online at the MyHouse Website.
4. Loading value and activation of your Gift Card
You must specify the quantity of Gift Cards you wish to purchase and then nominate the value you wish to be loaded on the Gift Card(s). Please note that a minimum of $25.00 and a maximum of $500.00 can be loaded onto each Gift Card. When you purchase a Gift Card online for the first time you will need to create an account. Please refer to clause 10 of these Gift Card Terms and Conditions with details of how we manage the personal information that we may collect from you with respect to Gift Cards.
You can pay for your Gift Card value with any payment method accepted by us at the time of purchase (other than with another Gift Card or Reward Points).
The transaction will be completed when the Gift Card is loaded with value and activated by us. Gift Cards will be activated within 48 hours from the time of purchase. In the unlikely event of a delay with the activation of the Gift Card, you may temporarily be unable to make purchases using the Gift Card. 5. Using your Gift Card
Making a purchase with your Gift Card online
Select the Products that you wish to purchase online with your Gift Card, follow the prompts and enter your Gift Card number and Access Code at the checkout.
By entering the Gift Card number and Access Code at the checkout, you authorise us to reduce the total value or Residual Value of your Gift Card by the value of the Products purchased. The transaction will be completed when the value has reduced on your Gift Card.
No change will be given for any Residual Value. The Residual Value may only be used for future purchases until the Gift Card expires.
Purchases exceeding the Residual Value
If you wish to make a purchase of goods for an amount that exceeds the available value of the Gift Card (whether that be the initial total value or the Residual Value), you will be required to pay the difference using another form of payment. If making a purchase online, you can combine your Gift Card with a credit card as payment.
Purchases under $20 value
Gift Cards may not be used to purchase goods under the amount of $20. If you wish to make a purchase of goods for an amount that is less $20, you may be required to pay using another form of payment.
Exclusions
Gift cards or online gift vouchers and Click & Collect Orders are not available for the purchase of Gift Cards, or for the purchase of online exclusive products, or for certain promotional offers from time to time at our sole discretion.
Earning Reward Points
Reward Points will be earned when using a Gift Card to purchase Products online.
Exchanging items purchased with a Gift Card
Products that are purchased in whole or in part with a Gift Card may be returned, exchanged, or replaced subject to our Returns Policy and in accordance with the Australian Consumer Law.
Our Returns Policy includes the right for us to issue a Gift Card instead of other tender or cash, in certain circumstances.
No cash advances
You cannot redeem Gift Cards for cash or use Gift Cards to obtain cash advances.
Checking your Gift Card balance, expiry date and transaction history
You will not be sent statements of transactions for your Gift Card. You can check your Gift Card balance and expiry date at any time in store or by emailing support@myhouse.com.au. For balance enquiries by phone you will be required to provide both the Gift Card number and Access Code on your Gift Card prior to getting access to the Gift Card information.
If we believe that an administrative or accounting error has occurred, we reserve the right to correct the balance of your Gift Card.
No exchange of Gift Card
You cannot exchange your Gift Card for a different denomination or for another tender, cash or discount.
No purchase of another Gift Card
You cannot use a Gift Card to purchase another Gift Card.
Gift Cards cannot be reloaded
If the value of the Gift Card has been exhausted (ie there is no Residual Value), it cannot be reloaded and should be destroyed.
6. Expiry of Gift Cards
Gift Cards are valid for 3 years from the date of supply or until no amount remains on the gift card, whichever is earlier.
On expiry, the Gift Card will automatically become invalid, and any residual value will not be refunded or credited and will become our property.
It is up to you to use the full value of the Gift Card before the expiry date.
7. Voiding and cancellation of Gift Cards
A Gift Card is void once it is expended or expires.
We may also cancel Gift Cards in the following circumstances:
8. Lost, stolen, or damaged Gift Cards
You are responsible for the use, security, and care of your Gift Card.
You are liable for all transactions on your Gift Card (except to the extent of any fraud or negligence by us).
The person in possession of the Gift Card will be treated as the owner of the Gift Card.
Lost or stolen Gift Cards will not be replaced or refunded.
Defaced, mutilated, damaged, or altered Gift Cards will not be redeemed, replaced or refunded, unless such damage is proven to have been caused by us or our agents or contractors.
9. Changes to Terms and Conditions
We may at any time vary any of the terms contained in these Gift Card Terms and Conditions. The varied terms will be published on the Website and in selected marketing materials. The varied terms will take effect from the date that they are published on the Website (Variation Date).
If you do not agree to the varied term, you must notify us in writing within 14 days of the Variation Date. If you notify us within the notice period that you do not accept the varied terms, we may cancel your Gift Card and refund any Residual Value to you.
10. Privacy and confidentiality
Our Privacy Policy and Privacy Collection Statement explain how we manage the personal information that we may collect from you with respect to Gift Cards. You can access the Privacy Policy on our Website, or you can request a copy by emailing support@myhouse.com.au
11. Limitation of liability
These Gift Card Terms and Conditions do not affect your statutory rights. Other than those statutory rights that cannot be excluded, any conditions implied by any other laws are excluded from these Gift Card Terms and Conditions.
To the extent permitted by law:
We do not warrant or represent that at any particular time a particular store will be a participating store. To the extent permitted by law, we exclude all liability to you in the event that a store does not accept your Gift Card.
12. Applicable law
These Gift Card Terms and Conditions are governed and interpreted in accordance with the laws of Victoria, Australia. Any dispute in connection with a Gift Card is exclusively subject to the jurisdiction of the courts of Victoria, Australia and the Federal Court of Australia.
